Terms of Use and Legal Notice

These Terms of Use apply to the YomuLens mobile application and related services (“YomuLens”, “the Application”, “we”, “us”, or “the Service Provider”).

The Application is operated by a French micro-entrepreneur. Contact details for privacy questions and data protection requests are provided in the Contact section at the end of these Terms.

1. Agreement to These Terms

By using YomuLens, you agree to these Terms. If you do not agree, do not use the Application.

2. What YomuLens Provides

YomuLens is a language learning, reading, OCR, and study tool. The Application may allow you to:

YomuLens is a tool. It does not sell, provide, host, or verify books, websites, PDFs, EPUBs, CBZ files, or other third-party content imported or accessed by users.

3. User Content and Responsibility

You are entirely responsible for the files, images, books, documents, archives, text, webpages, and other content that you import, open, scan, process, translate, save, or access using YomuLens.

You agree that you will only use YomuLens with content that you own, have lawfully obtained, are authorized to use, or are legally permitted to access.

YomuLens does not verify whether imported files, webpages, books, images, or other content are lawful, licensed, copyrighted, pirated, offensive, harmful, or otherwise restricted. The fact that the Application can open, scan, display, OCR, or translate content does not mean that you have the right to use that content. YomuLens does not monitor, review, or verify imported local content.

You must not use YomuLens to infringe copyright, violate intellectual property rights, bypass access controls, distribute unauthorized copies, or violate applicable laws.

4. Third-Party Websites

YomuLens includes an in-app browser and reader mode features. Websites opened through the Application are controlled by third parties, not by YomuLens.

You are responsible for the websites you visit and for complying with their terms, policies, copyright rules, access restrictions, and applicable laws.

YomuLens is not responsible for third-party websites, their content, their availability, their security, their advertising, or their data practices.

5. OCR, Translation, and AI Results

OCR, translation, and AI-assisted features may produce inaccurate, incomplete, offensive, misleading, or unexpected results.

YomuLens does not guarantee the accuracy, reliability, completeness, legality, or suitability of OCR, translations, generated example sentences, pronunciation checks, dictionary matches, or study content.

You should not rely on YomuLens for professional, legal, medical, financial, immigration, academic, or other high-stakes decisions.

6. Third-Party Services and API Keys

Some features may use third-party services, including Cloudflare for model file hosting and optional Cloudflare Workers AI translation, Hugging Face fallback or community services where available, Mistral, Google services, device or operating system speech services, and pronunciation audio providers.

If you select Cloudflare AI translation, YomuLens sends the text you ask to translate to a YomuLens-operated Cloudflare Worker, which uses Cloudflare Workers AI to generate the translation. Cloudflare AI availability, quotas, rate limits, model behavior, and regional availability may change over time. If Cloudflare AI is unavailable or capped, YomuLens may fall back to on-device translation where available.

If you choose to use a third-party service with your own API key, you are responsible for:

YomuLens is not responsible for third-party service outages, pricing, limits, model downloads, model behavior, account actions, or data handling by those providers.

7. Advertising and Rewards

YomuLens may display ads, including banner ads, interstitial ads, and rewarded ads.

Rewarded ads may unlock or provide access to certain app features, lessons, or benefits. Rewards are granted only when the ad provider confirms that the reward conditions were completed.

Ads may fail to load, may be unavailable, or may vary by region, device, network, consent status, or third-party provider rules. YomuLens does not guarantee that ads or rewards will always be available.

Advertising data processing is described in the Privacy Policy.

8. Local Data and Backups

YomuLens stores app data locally on your device, such as library metadata, reading progress, vocabulary, study progress, favorites, settings, and user-provided API keys.

Backup exports are created only when you choose to export them. Backup exports do not include API keys, but may include vocabulary data, saved words, readings, definitions, example sentences, and study progress related to those vocabulary items.

You are responsible for storing, protecting, sharing, importing, deleting, and managing any backup files you create.

9. App Availability and Changes

YomuLens may change, suspend, remove, or discontinue features at any time, including OCR, translation engines, lessons, ads, browser features, import formats, or third-party integrations.

Some features depend on third-party services, device capabilities, operating system permissions, internet access, or regional availability.

We do not guarantee that the Application will always be available, uninterrupted, error-free, secure, or compatible with every file, website, device, or operating system version.

You agree not to misuse YomuLens. You must not:

YomuLens, including its interface, code, design, original lessons, original text, graphics, and branding, is protected by intellectual property laws.

These Terms do not grant you ownership of YomuLens or any YomuLens intellectual property.

Third-party content, imported files, websites, dictionaries, models, SDKs, libraries, and services remain the property of their respective owners.

12. No Professional Advice

YomuLens is provided for language learning, reading, and study purposes. It does not provide professional advice.

OCR, translations, explanations, examples, and learning materials may contain errors. You are responsible for verifying information before relying on it.

13. Limitation of Liability

To the maximum extent permitted by applicable law, YomuLens and the Service Provider are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of access, loss of content, loss of profits, service interruptions, inaccurate OCR or translations, third-party service issues, ad availability, or user misuse of the Application.

Nothing in these Terms limits liability where it cannot legally be limited.

14. Termination or Restriction

We may restrict, suspend, or discontinue access to the Application or related services if necessary to protect the Application, comply with law, respond to legal requests, prevent abuse, or enforce these Terms.

Use of YomuLens is also governed by the Privacy Policy, which explains how data is processed by the Application and third-party services.

16. Changes to These Terms

We may update these Terms from time to time. If material changes are made, we will update the effective date and, where required, notify users or request consent.

17. Governing Law

These Terms are governed by the laws of France, unless mandatory consumer protection laws in your country of residence provide otherwise.

18. AI-Generated Assets

Some audio, voice, image, illustration, character, background, or other media assets included in YomuLens may be created or assisted by artificial intelligence tools, including text-to-speech or voice design tools.

These assets are provided as part of the YomuLens app experience. Except where permitted by applicable law or expressly authorized by us, you may not extract, redistribute, resell, clone, train on, or separately commercialize media assets included in the Application.

Nothing in these Terms grants you ownership of YomuLens assets, third-party assets, AI models, voice models, or the underlying tools used to create them.
